Governments are always making policy errors. It is rare, however, that such a serious misjudgment erupts into a catastrophe with the speed that Biden’s immigration plan has.
Since Joe Biden was inaugurated to be the 46th U.S President, he has always made many mistakes. Not to mention Biden’s surrender of Afghanistan to Taliban jihadists, Bien’s immigration policy has been a mistake.
On January 23, 2021, President Joe Biden proposed an immigration bill to Congress. The bill would provide a pathway to citizenship for the 11 million illegal immigrants currently living in the United States.
Joe Biden’s immigration policy is largely based on reversing many of the previous Trump administration’s immigration policies. During his first day in office, Biden reversed many of Trump’s policies on immigration, such as halting the construction of the Mexico border wall or ending Trump’s travel ban restricting travel from 14 countries.
America is no longer “America first”. Biden has expanded legal immigration and turn America is a free and safe haven for refugees.
Biden has also not yet fulfilled some of his campaign promises, such as ending for-profit immigration detention and repealing the Trump administration’s rules that disqualified victims of gang and family violence from the asylum.
A record increase in unaccompanied children at the southern border has consumed much of the Biden administration’s initial work on immigration. The Republican attorneys general have posed legal challenges to Biden’s immigration policies, successfully preventing his proposed 100-day freeze on most deportations.

Biden has retained Trump’s widest restriction
During the campaign, Biden pledged to restore US asylum laws, criticizing Trump’s border policies as draconian and inhumane.
On Inauguration Day, Biden suspended the so-called Remain in Mexico program, which required 70,000 asylum seekers to wait outside the United States while their cases were arbitrated. Since then, Biden’s administration has accepted more than 8,000 asylum applicants who had previously applied for the program and allowed them to remain in the United States pending a final decision on their applications.
In February, the Biden administration pulled out of three Trump-era deals with Guatemala, Honduras, and El Salvador that allowed US border officials to reroute asylum seekers to these nations. The move was mainly symbolic because the agreement with Guatemala was the only one that had been completed, and deportations accordingly were halted in March 2020 due to the pandemic.
In spite of these changes, the Biden administration has continued to invoke a little-known public health agency first cited under former President Donald Trump to deport tens of thousands of migrants without allowing them to apply for asylum in the US.
The Biden administration has refused to deport unaccompanied immigrant children under the public health agency, called Title 42. However, border agents have continued to deport most grown-up migrants and asylum-seekers, including families with children, to Mexico or their homeland.
Biden built a task force to determine and reunite parents and children who migrated apart after being separated from each other near the southern border under the Trump administration. But, the task force hasn’t yet reunited a family.
Biden has gradually loosened Trump-era restrictions on legal immigration
After Biden was sworn in, he remove Trump’s travel and immigration restriction for 14 countries, most of which are of Muslim or African descent.
In late February, Biden rescinded Trump’s statement that banned most immigrant visas during the pandemic. However, he did not elevate the same restrictions Trump put on work visas last summer, instead of letting them expire at the end of March.
In March, the Biden administration stopped enforcing Trump-era “public charge” rules that give immigration adjudicators broader discretion to deny green card applications from immigrants identified as relying on or at risk of relying on public aid, such as housing vouchers and food stamps.
The Biden administration has restored an Obama-era initiative to allow some kids in the region to reunite with families in the United States. Biden’s deputies described the program as an alternative to the arduous journey some Central American children begin to get to the US border.
Biden surrenders border when migrants continue to arrive at the US-Mexico border in record numbers
During Biden’s first weeks in office, he restated his campaign promise to accept up to 125,000 refugees in the financial year 2022, a sevenfold increase compared to the record-low 15,000-point cap former President Donald Trump set. Biden also pledged to make the “down payment” by increasing the current financial year’s refugee cap to 62,500.
But Mr. Biden delayed signing the paperwork needed to enact his proposed changes for weeks, leading to the cancellation of flights for hundreds of travel-ready refugees who were subject to the Trump-era restrictions.
Biden eventually enacted a refugee order earlier in April. While he terminated Trump’s rules that restricted who qualified for refugee resettlement, he kept the historic-low 15,000-person cap, provoking swift and vocal condemnation from political parties.
Migrants continue to reach the US-Mexico border in record numbers at a time when arrivals typically drop due to the sweltering summer heat. According to US Customs and Border Protection, the agency encountered 212,672 people at the US-Mexico border in July, the highest level in two decades.
Homeland Security Secretary Alejandro Mayorkas recognized the “serious challenge” that the administration was facing.
“We are facing a serious challenge at our southern border, and the challenge is of course made more acute and more difficult because of the Covid-19 pandemic. It has also been made more difficult because of the fact that the prior administration dismantled our asylum system,” he said.
In the administration’s attempt to distance themselves from Trump’s immigration-restrictive program and recognize compassion, Biden officials often sent conflicting messages about who is allowed into the United States and when. As a result, the border situation remains a political responsibility for the White House, which has drawn criticism from both the left and the right.
Republicans say that Biden is having a border crisis of his own making, while Democratic progressives have criticized that Biden is not moving fast enough to relax Trump-era policies.
Border arrests are still at the highest levels in decades, reaching one million before the end of the financial year. The number of unaccompanied children in CBP custody has skyrocketed. Whistleblowers have made accusations that poor conditions at a makeshift children’s facility are now also the subject of a government watchdog review. And immigration advocacy groups have criticized the administration’s decision to continue deporting migrants encountered at the border.
It is reported that there were about 19,000 unaccompanied kids arrested in July, marking a new record. On August 11, nearly 1,042 unaccompanied children were kept in CBP, similar to prison-like facilities designed for adults, not children.
The root of the recent rise in illegal border crossings is actually Biden’s prolonged maintenance of the most restrictive of the former president’s policies: the near-complete severance of asylum, a form of legal immigration. It’s not exaggerated that Biden surrenders U.S border, one of the most difficult challenges now.
