U.S. to send deportation case notices to 78,000 migrants who were not fully processed

The plan, aka “Operation Horizon,” involved US Immigration and Customs Enforcement authorities sending a number of documents to migrants, including “notice to appear” in court, where immigration judges will determine if they can stay in the United States or be deported, CBS News first reported it, citing two people briefed on the plans.

Illegal immigrants, numbering approximately 78,000, will receive packages of documents, including documents instructing them to report to the ICE office closest to where they live, and they will be processed for possible deportation.

Agents will record biometric information, take photos, and notify them of future check-in requests and court dates.

“Action will be taken against those that do not appear consistent with the law and department priorities. By mailing out these charging documents, ICE is initiating removal proceedings in a timely way,” the spokesperson stated.

This year, the United States has seen record levels of illegal migrants crossing the border from Mexico. In October, CBP revealed arrests made by the Border Patrol in the fiscal year 2021 hit their highest level since 1986 – more than 1.3 million arrests in total.

As of September, the department has brought more than 107,000 officially undocumented migrants to court, and about 28% have failed to report them to ICE over a 60-day period, according to the Associated Press.

Normally, when illegal immigrants are detained by the Border Patrol and they want to claim a credible fear of returning to their home country or the first step in the asylum process, an asylum officer will conduct a credible fear screening.

Illegal immigrants who pass the screening are released into the interior of the United States and have one year to officially apply for asylum — something a large number fail to do.

However, in light of the number of illegal immigration this year, the Biden admin has released hundreds of thousands of illegal immigrants without official documents, telling them to report to the local ICE office within 60 days.

The end of the year is approaching, and the migrant convoys continue to approach the southern border. Just last week, nearly 100 Republican lawmakers urged the Department of Homeland Security to detail how it plans to deal with a caravan of thousands of migrants arriving in the United States.

Chad Wolf – a former head of the Department of Homeland Security (DHS), said the move showed the Biden admin was dysfunctional in its handling of immigration enforcement.

“Since this admin could not effectively manage the border, DHS must now expend considerable resources to track down illegal immigrants. This is what disfunction looks like and another example of how Biden Broke the Border.” he wrote on Twitter.

Director of policy studies at the Center for Immigration Studies – Jessica Vaughan wrote on Twitter that it will be interesting to see how many notices appear to be returned to the government, not to mention how many immigrants actually show up in court.

Those who do not comply with the notices face deportation but can appeal. However, she said, with a bogged-down court system, evictions are unlikely to happen quickly, if at all.

House GOP Conference Chair Elise Stefanik (R-NY) said in a statement.

Amy Fischer, advocacy director at Amnesty International USA, told CBS, which first reported the mass mailings, that she was concerned immigrants might not get the notice from Customs and Border Protection (CBP). She said.

“We know that when people are entering, they give CBP an address and it’s typically an address of where they know somebody in the United States. But that doesn’t mean that it is where they will reside”, “We also know that CBP has a long history of writing down inaccurate information.”

ICE declined to say how many were granted lower-level notices to report, and the Freedom of Information Act request for data has yet to be returned.

“Obviously, the better practice would be to have individuals be noticed to appear as opposed to noticed to report,” Chris Magnus, Biden’s nominee to head CBP, told a Senate panel last month.

Magnus, who said he was unsure of the legal basis to give the notices to report, blamed a shortage of asylum officers and immigration judges, and a “broken” immigration system due to a policy change.

Magnus also declined to say that the situation at the border constitutes a crisis, a move that drew contempt from Republican lawmakers.

The fact that President Biden praises radical immigration ideals on one hand and enforces border policies on the other not only confuses immigration and immigration officials but also raises questions about whether this president ever had a decent strategy on immigration.

Biden has tried both ways by being both harsh on the border and trying to help undocumented immigrants avoid deportation. But this approach of his only aggravated the injustices in the US immigration system.
