The Biden administration is reportedly considering issuing payments to immigrant families separated at the southern border during the Trump administration with compensation of about $450,000 per person, for a total payout that could cost the government more than $1 billion, the Wall Street Journal reported Thursday afternoon

People familiar with the matter told the Wall Street Journal that the Departments of Justice, Homeland Security, Health and Human Services are considering the payments that could reach nearly $1 million for two people within the same family to settle lawsuits claiming that the government has caused long-term psychological trauma to parents and children.

The American Civil Liberties Union, said about 5,500 children were separated from their parents at the border during the Trump administration.

Separation occurred during Trump’ Trump’s zero-tolerance policy, which started in April 2018 under an executive order that was issued without warning to other federal agencies that would have to administer the policy. This policy subject all adults to unauthorized entry into the US, including those with children, were referred for prosecution.

The children who went with those adults were separated from them and placed into the custody of the Department of Health and Human Services. Since then these children have not been reunited with their families, as some of the parents were deported. Former President Trump later ended the policy in an executive order on June 20,20218.

The lawsuits allege that the separation caused long-term mental health problems for the children from the trauma of months without their parents.

Sources told the WSJ that the lawsuits claim a wide range of damages, with the average claim being about $3.4 million per family. Lawyers for the government and family have told the court they hope to reach an agreement by the end of November.

Lee Gelernt, deputy director of the ACLU’s immigrant rights project and lead negotiator on one of the lawsuits, argued that the remedy for separated families “must include not only meaningful monetary compensation, but a pathway to remain in the country”.

The Biden administration has repeatedly denounced the policy as inhuman and cruel and promised to reunite families still separated.

Earlier this month, Michelle Brane, the head of the Family Reunification Task Force, said the Biden team has only been able to reunite 52 of the more than 1,000 families separated under the policy that have not yet been found.

‘We estimate that over 1,000, somewhere between 1,000, 1,500, maybe more remain separated,’ Brane said on CBS’ 60 Minutes on Oct. 12. ‘It’s very hard to know because there’s no record.

She added: ‘So there’s nowhere to go to find out who was separated or not. It really is case-by-case detective work.’

The task force is said to be in the process of reuniting another 200 people. The reunited families are then granted a three-year pardon, which allows them to live and work legally in the United States for that period, but is not offered a pathway to citizenship.

However, senior ministry officials have rejected this comparison because the US government is not responsible for terrorist attacks. Republicans were quick to criticize the affordability of illegal immigrants on Thursday afternoon, accusing the Biden administration of prioritizing asylum seekers over US citizens. And they quickly condemned the report.
